Dear Members,
Your committee has for some years now been in discussion with the Council about the maintenance and repair of the lock and weir. The Council conducted a tender process, and work that was to cost $1.2M in 2020 has now blown out, which will result in Council imposing a new levy.
More recently, a sub-committee of President Neale, VP Adrian and Secretary John have been engaging with the Council to gain some understanding of what we are being asked to pay for, and the projects timeline and completion date. To that end we have asked on a number of occasions to see the Tender documentation by which the preferred Tenderer was selected. Despite being told that the documents would be made available, we still have not seen them.
The Council asked us to provide the NWRA response to the proposed Tender by noon today. The sub-committee met and determined:
Although the tender documents have not been provided, the Council strongly assures us that it has conducted an appropriate due diligence by which it concluded:
The Tenderer has significant experience on similar projects;
The Tenderer has actual lock and weir experience;
The Tenderer has that experience in the Sunshine Coast area;
The Tenderer has a sound methodology, good track record, and the necessary resources to meet the program of works.
Without visibility of the documents, your sub-committee can only accept those Council assurances at face value. We are therefore not in a position to suggest the Tender should not proceed today, and have advised the Council of this before noon today.
However, NWRA will continue to pursue access to the documents via the Council's formal process. We will analyse them once received, and inform you of the results.

Looking at the successful tenderer's current website - https://www.kellybourke.com.au/ , unfortunately there does not appear to be a great deal of published detail that you would normally expect to be associated to an marine infrastructure remediation and engineering company. Furthermore, unless I am mistaken the image on the kellybourke website home page under Locks, appears to be the same image from a US website of a lock in Nashville - https://www.lrn.usace.army.mil/Media/Images/igphoto/2000950674/
It is also perhaps interesting to note that the company (Kellybourke) was only recently registered with its Entity Status Effective from 21-12-2021, just six months before the tender was awarded.
With an expenditure for the Noosa Waters Lock Update costing some $1.8m, I would have anticipated that…
Hi Peter, the original budget was $1.2M. That has now risen to $1.8M.
